Terms of Use

These Terms govern your download and use of AnnaSutra, a catering event and order planning app provided by Tatvarth Systems LLP ("Tatvarth Systems", "we", "us"). They are a complete set of terms for AnnaSutra. Our website is covered separately by the company Terms of Use. How we handle personal data is explained in the AnnaSutra Privacy Policy.

Scope and acceptance

By installing or using AnnaSutra you agree to these Terms. If you use it for a business, you confirm that you are allowed to accept them for that business. If you do not agree, do not use the app. If you have a signed agreement with us for AnnaSutra, that agreement prevails where it conflicts with these Terms.

Who can use AnnaSutra

AnnaSutra is business software for people aged 18 and over. There is no account or sign-in. The app belongs to the phone it is installed on, so whoever holds your phone can use it. Keep your phone locked and tell us if you think someone has misused it.

Your licence to use the app

We give you a personal, non-exclusive, non-transferable, revocable licence to install AnnaSutra on your own devices and use it for your catering business, while you follow these Terms. You may not copy, sell, rent, sublicense or distribute the app, reverse engineer or modify it, remove any notices from it, or use it to build a competing product.

What AnnaSutra is, and is not

AnnaSutra helps you keep events, menus and suppliers in one place, works out ingredient quantities from the recipes and guest counts you enter, and prepares order lists you can share with suppliers.

Quantities are estimates. They depend entirely on the recipes, guest counts and units you enter. Check every quantity before you place an order. We are not responsible for shortages, surplus, wastage or cost that result from relying on an estimate without checking it.

AnnaSutra is not an accounting, invoicing, tax or payment tool, and it does not place orders for you or guarantee that a supplier will receive, accept or fulfil one. Your arrangements with suppliers and customers are between you and them.

Free trial and plans

Every installation starts with a free trial of 30 days, beginning at first launch. The trial is for one installation on one device. After it ends, AnnaSutra becomes read only: you can still view your data and send order lists you have already created, but you cannot add or change anything. To keep editing, contact us for a plan.

There are no payments inside the app. If you take a paid plan, its price, term and any other conditions will be set out in the order form or message we send you and, once agreed, form part of these Terms. We may change how the trial works for future installations, but we will not shorten a trial already running.

Your data and backups

The events, menus, recipes, supplier and customer details and other content you enter belong to you. They are stored on your phone and we do not receive them, as the Privacy Policy explains.

You are responsible for your data. AnnaSutra does not back up to the cloud. If you lose your phone, reset it, uninstall the app or choose Delete all data, your information may be gone for good and we cannot restore it. Keep your own copies of anything important, for example the order lists you have shared.

If you enter personal data about customers or suppliers, you confirm that you may lawfully hold it and will use it only for your business, in line with applicable law including the DPDP Act.

Acceptable use

You agree not to:

  • use AnnaSutra for anything unlawful or to harm others;
  • try to get around the trial limits, including by changing your device clock or tampering with the app;
  • interfere with the app, its updates or Google Play, or probe them for weaknesses;
  • enter content you have no right to use, or content that infringes someone else's rights.

Order lists and sharing

When you send an order list, you choose the app and the recipient, and the PDF leaves AnnaSutra and goes to them. We cannot see it, recall it or control what the recipient does with it. Check the supplier and the details before you send.

Availability and updates

We work to keep AnnaSutra useful and reliable, but it is provided as available. We may update, add to, change or retire features, and some updates may be needed to keep the app working. The app is distributed through app stores such as Google Play, and your use of those stores is governed by their own terms. We are not responsible for store outages or for your phone, network or operating system.

Intellectual property

AnnaSutra, its design, code, name and logo belong to Tatvarth Systems LLP and are protected by law. These Terms give you a right to use the app and nothing more. If you send us feedback or ideas, we may use them to improve AnnaSutra without owing you anything.

Warranties

To the extent the law allows, AnnaSutra is provided "as is" and "as available". We do not promise that it will be uninterrupted or error free, that estimates will be accurate for your needs, or that it will suit a particular purpose.

Limit of liability

To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of profit, business, goodwill or data, arising from your use of AnnaSutra. Our total liability to you for any claim relating to the app is limited to the amount you paid us for it in the 12 months before the claim, or INR 1,000 if you have paid nothing. Nothing here limits liability that cannot be limited by law.

Your responsibility

You agree to cover us against claims, losses and reasonable costs arising from your breach of these Terms, the content you enter, or your dealings with your customers and suppliers.

Force majeure

Neither party is liable for delay or failure caused by events beyond its reasonable control, including natural disaster, war, civil unrest, epidemic, utility or internet failure, an app store outage, or government action.

Ending your use

You can stop using AnnaSutra at any time by uninstalling it. We may suspend or end your licence if you breach these Terms. When your licence ends, you must stop using the app. Clauses that by their nature should continue, such as those on data responsibility, liability and governing law, continue to apply.

Assignment, severability and entire agreement

You may not assign these Terms without our written consent. We may assign them in a merger, reorganisation or sale of business, or to an affiliate. If any provision is held unenforceable, it is limited to the minimum extent needed and the rest stays in force. Our not enforcing a provision is not a waiver. These Terms and any order form are the whole agreement for AnnaSutra and replace earlier understandings on it.

We may give notice inside the app, on this page, or by email to the address you have given us. Send notices to us at legal@tatvarthsystems.com.

Governing law and disputes

These Terms are governed by the laws of India. We will first try to resolve any dispute in good faith. If that fails, it will be referred to arbitration under the Arbitration and Conciliation Act, 1996, before a sole arbitrator, seated in Pune, Maharashtra, and conducted in English. Subject to that, the courts at Pune, Maharashtra have exclusive jurisdiction.

Changes to these Terms

We may update these Terms as AnnaSutra grows, for example when features such as cloud backup, accounts or paid plans in the app are introduced. We will publish the new version with a new effective date and version number, and for material changes tell you inside the app or by email at least 14 days before it takes effect. Continued use after that date means you accept the update.
