These Terms govern your access to and use of Sampreshan, a website inquiry management solution provided by Tatvarth Systems LLP ("Tatvarth Systems", "we", "us"). They are a complete set of terms for Sampreshan. Our website is covered separately by the company Terms of Use.
Scope
These Terms apply to your business's use of Sampreshan, to every website connected to it, and to anyone who signs in to its dashboard. If you have a signed order form or agreement with us for Sampreshan, that agreement prevails where it conflicts with these Terms.
Sign-in and access
Each connected website has one shared sign-in, made up of an email address and a password. There are no separate roles or per-person accounts. Anyone who has the sign-in can see and act on every inquiry for that website, so you decide who gets it. You are responsible for keeping the credentials confidential and for all activity carried out with them. Tell us promptly if you suspect unauthorised access.
People who send an inquiry through your website form do not receive accounts and never sign in. They are visitors to your website, not users of Sampreshan.
What Sampreshan is, and is not
Sampreshan receives submissions from the inquiry forms on your website, checks them for bot activity, stores them, and shows them in a dashboard where your team can track status, add notes and tags, reply by email, view analytics and export the data.
Sampreshan is not a customer relationship management system, a backup of your website, or a guarantee that every message will arrive. No bot check is perfect, so some spam may get through and an occasional genuine message may be blocked. You remain responsible for responding to your own enquirers.
Your data
The inquiries collected through your website, and the notes, tags and replies your team adds to them, belong to your business. We hold and process them on your instructions to provide Sampreshan and for no other purpose. The Sampreshan Privacy Policy explains this under the DPDP Act.
Your website and its visitors
You are responsible for your website and for the people who write to you through it. That includes telling visitors, in your own privacy notice, that their details are collected and handled through Sampreshan, having a lawful basis to collect them, and replying in line with the law. You are also responsible for the content of the replies you send.
Acceptable use
You agree not to:
- share your sign-in with people who should not see your inquiries;
- try to reach another business's inquiries, or probe, scan or test the platform's security without our written permission;
- use Sampreshan to send spam, unsolicited bulk messages, or anything misleading, abusive or unlawful;
- connect a website you are not authorised to operate;
- use automated means to scrape or extract data at scale, or bypass the bot checks or rate limits;
- interfere with how Sampreshan operates or introduce malicious code.
Fees
Fees, billing and payment terms for Sampreshan, if there are any, are set out in the order form or agreement between you and us. We do not charge for Sampreshan unless we have agreed it with you in writing. Fees exclude GST and other applicable taxes unless the agreement says otherwise.
Email notifications and replies
Sampreshan sends new-inquiry notifications and your replies through a third-party email provider. Delivery depends on that provider and on the receiving mail system, so we cannot promise that any particular email will be delivered or will avoid a spam folder. A reply is recorded in the dashboard only after the email provider has accepted it for sending.
Availability and support
We run Sampreshan with commercially reasonable efforts to keep it available and to respond to support requests sent to contact@tatvarthsystems.com during Indian business days. We may take it offline for maintenance, with notice where practical, and features may change as the product improves. If Sampreshan is unavailable, submissions sent from your website during that time may not be saved. Any uptime or response-time commitment applies only if it is written into your order form.
Data export and termination
When your use of Sampreshan ends for any reason, we will keep your inquiry data available for export in a usable format for 30 days. You can also export inquiries to CSV from the dashboard at any time. After that window we delete your data as described in the Sampreshan Privacy Policy, except where the law requires us to retain it.
We may suspend or end access for breach of these Terms, non-payment of agreed fees, or a security risk. Except where there is an urgent security or legal reason, we will give written notice and a reasonable chance to fix the problem first. Provisions that by nature should survive, including intellectual property, disclaimers, liability and governing law, continue after termination.
Intellectual property
Sampreshan's software, design and branding belong to Tatvarth Systems LLP. You receive a limited, non-exclusive, non-transferable right to use Sampreshan for your own business inquiries while your access is active. Ownership of the software does not transfer. Your data remains your own.
Disclaimer of warranties
Sampreshan is provided "as is" and "as available". We work to keep it reliable, but to the fullest extent the law permits we do not warrant that it will be uninterrupted or error-free, that every submission will be received, or that every email will be delivered.
Limitation of liability
To the fullest extent the law permits, our total liability for any claim relating to Sampreshan is limited to the fees you paid us for it in the 12 months before the claim arose. We are not liable for indirect or consequential loss, including lost business or opportunities from an inquiry that was missed, blocked or not delivered.
Nothing in these Terms limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that cannot be limited by law.
Indemnification
You agree to indemnify Tatvarth Systems LLP against claims arising from your misuse of Sampreshan, your breach of these Terms, the content of your replies, or your violation of law in how you collect and handle your visitors' data.
Force majeure
Neither party is liable for delay or failure caused by events beyond its reasonable control, including natural disaster, war, civil unrest, epidemic, utility or internet failure, failure of a cloud provider's infrastructure, or government action.
Assignment, severability and entire agreement
You may not assign these Terms without our written consent. We may assign them in a merger, reorganisation or sale of business, or to an affiliate. If any provision is held unenforceable, it is limited to the minimum extent needed and the rest stays in force. Our not enforcing a provision is not a waiver. These Terms and any order form are the whole agreement for Sampreshan and replace earlier understandings on it.

We may give notice by email to the sign-in email address for your website, through Sampreshan, or on our website. Send notices to us at legal@tatvarthsystems.com.
Governing law and disputes
These Terms are governed by the laws of India. We will first try to resolve any dispute in good faith. If that fails, it will be referred to arbitration under the Arbitration and Conciliation Act, 1996, before a sole arbitrator, seated in Pune, Maharashtra, and conducted in English. Subject to that, the courts at Pune, Maharashtra have exclusive jurisdiction.
Changes to these Terms
We may update these Terms as Sampreshan evolves. For material changes we email the sign-in address for your website and publish the new version with a new effective date and version number at least 14 days before it takes effect. Continued use after that date means you accept the update.
