SamyakSeva — Terms of Use

Scope

These Terms apply to your trust's use of SamyakSeva and to every user account provisioned under it. Where your trust has a signed order form or agreement with us for SamyakSeva, that agreement governs where it conflicts with these Terms.

Accounts and roles

Access to SamyakSeva is granted per user, at one of several roles (Viewer, Operator, Admin, Owner), each with different permissions within your trust's own data. Your trust's Owner is responsible for who holds each role. You are responsible for keeping your own credentials confidential and for all activity recorded under your account.

Members, donors, and shravaks whose records your trust keeps in SamyakSeva do not receive accounts and never sign in. They are records your trust maintains, not users of the software.

What SamyakSeva is, and isn't

SamyakSeva is a double-entry ledger and reporting tool built for mandir and public-trust bookkeeping. It derives statutory statements (Trial Balance, Income & Expenditure, Balance Sheet, Form 10BD) from the entries your trust records, and it enforces gapless receipt numbering and an immutable audit trail.

SamyakSeva is not a chartered accountant, auditor, or tax adviser, and using it does not substitute for one. It is a record-keeping and reporting tool; your trust remains responsible for the judgement calls that go into its accounts and filings.

Your trust's data

Every record your trust enters into SamyakSeva (ledger entries, receipts, pledges, member and donor records, inventory) belongs to your trust. We hold and process it on your trust's instructions, to provide the software, and we do not use it for any other purpose. Statutory responsibility

SamyakSeva is built to keep your books consistent and your statutory statements derived correctly from them. It does not review the correctness of what your trust enters, decide how a transaction should be classified, or file anything on your trust's behalf. Your trust remains solely responsible for the accuracy of the data it enters and for meeting its own statutory and regulatory obligations, including under the Maharashtra Public Trusts Act and applicable tax law.

Acceptable use

When using SamyakSeva, you agree not to:

• share your account credentials with anyone else, or use an account role beyond what your trust has assigned you;
• attempt to access another trust's data, or probe, scan, or test the platform's security without our prior written permission;
• enter data on behalf of a trust you are not authorized to represent;
• use automated means to scrape or extract data at scale;
• interfere with or disrupt SamyakSeva's operation, or introduce malicious code.

Subscription and fees

Fees, billing cycle, and payment terms for SamyakSeva are set out in your trust's order form or agreement with us. Unless it states otherwise, invoices are due within 30 days and late payment may result in suspension of access.

Payments

SamyakSeva does not process your trust's donation or pledge payments, and it never handles payment card data. It only records payments your trust receives through its own channels: cash, bank transfer, cheque, UPI, or otherwise. Subscription fees for SamyakSeva itself are invoiced separately, as described above.

Availability and support

We aim to keep SamyakSeva available and responsive, and we support it as an active product. We may occasionally take it offline for maintenance, with notice where practical, and functionality may change as the product improves.

Data export and termination

If your trust's engagement with SamyakSeva ends, for any reason, we will make your trust's ledger and record data available for export in a usable format for 30 days afterward. We may suspend or terminate access for breach of these Terms, non-payment, or a security risk, subject to the notice terms in your trust's agreement.

Intellectual property

SamyakSeva's software, design, and branding are owned by Tatvarth Systems LLP. Your trust's agreement grants it a limited, non-exclusive right to use SamyakSeva for its own trust administration; it does not transfer ownership of the software. Your trust's own data remains its own, as described above.

Disclaimer of warranties

SamyakSeva is provided on an "as is" and "as available" basis. We work to keep it accurate and reliable, but we do not warrant that it will be uninterrupted or error-free, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, our aggregate liability for any claim relating to SamyakSeva is limited to the fees your trust paid us for it in the 12 months preceding the claim. We are not liable for indirect or consequential loss, including loss arising from data your trust entered incorrectly or a filing decision your trust made based on SamyakSeva's reports.

Indemnification

Your trust agrees to indemnify Tatvarth Systems LLP against any claim arising from its misuse of SamyakSeva, its breach of these Terms, or its violation of applicable law in how it operates the trust.

Governing law and dispute resolution

These Terms are governed by the laws of India, on the same terms set out in our site-wide Terms of Use: good-faith resolution first, then arbitration seated in Mumbai, Maharashtra.

Changes to these Terms

We may update these Terms as SamyakSeva evolves. When we make a material change, we will notify your trust's Owner and Admin users by email, in addition to revising the "Last updated" date above. Continued use after an update means you accept the revised Terms.
